Daniel Penny to be charged in subway chokehold death of Jordan Neely and will surrender to the NYPD tomorrow at 8 AM, sources tell FOX News reporter and field producer Marta Dhanis. He will be charged by Manhattan DA and not a grand jury, another source tells Dhanis. No word yet on the type of charges.
Penny, a 24-year-old Marine veteran, was questioned by police and released.
Neely, a homeless man, died after Penny held him in a chokehold for several minutes. The 30-year-old's death has been ruled a homicide by the medical examiner's office.
